Privacy Policy

PRIVACY POLICY – KICK IT OUT

 

  1. INTRODUCTION:

1.1           Kick It Out is a registered charity in England and Wales (number 1104056) whose offices are at Kick It Out, First Floor, Whittington House, 19-30 Alfred Place, London, WC1E 7EA (“Kick It Out”, “we” and “us”). Kick it Out takes the privacy of your information very seriously.

1.2           This privacy policy (the “Privacy Policy“) explains how and for what purposes we use the information we collect about you via our website at www.kickitout.org (the “Website”) and/or our mobile phone applications (the “Applications”).

1.3           The Website is based in, and the Applications may be based in, the United Kingdom and we take reasonable care to comply with the requirements of the UK Data Protection Act 1998 (the “Act”) relating to the personal information you supply on the Website or via the Applications.

1.4           For the purpose of the Act the data controller is Kick It Out.

1.5           Please read this privacy policy carefully. By agreeing to use the Website and/or the Applications, you are agreeing to be bound by this policy in respect of the information collected about you via the Website and/or the Applications.

  1. INFORMATION WE MAY COLLECT FROM YOU

2.1           We may collect and process the following information about you (“Personal Data“):

2.1.1            information that you provide by reporting alleged discriminatory activities or behaviour and filling in forms on the Website or in the Applications;

2.1.2            geo-locational data which will be sent to us when you report an incident involving discrimination in football either using the Applications or via the Website;

2.1.3            when reporting alleged or perceived discriminatory activities or behaviour, you may opt to submit your report and any information anonymously using the Applications or on the Website.  If you do not elect to submit a report anonymously, we may ask you to provide us with the following personal information:

(a)          your title, first name, surname, a user name, your gender and your date of birth;

(b)          your email address, postal address and telephone number;

(c)          legal guardian’s full name and relationship to child user (if applicable); and/or

(d)          your company, position, age, daytime telephone number, address, town/city, postcode and country. 

You may also provide us with personal information if you contact us with a query.

2.1.4            any information that you may provide when making purchasing Kick It Out merchandise or other products offered for sale via the online shop on the Website;

2.1.5            we may also collect information regarding your usage of the Applications and/or the Website, such as:

(a)          details of your visits to the Website, the resources you access and any data viewed or incidents of alleged or perceived discriminatory activity or behaviour reported;

(b)          the number of times you report alleged or perceived discriminatory activities or behaviour, the frequency with which reports are made at any particular site or football club, and any geo-location data which we receive as part of a report submitted by you via the Applications and/or the Website; and/or

(c)          any comments you provide as a user of the Website and/or the Applications, including communications you send to us, for example, to report an incident involving alleged or perceived discriminatory activity or behaviour, or to report a problem or to submit queries;

2.1.6            we may ask you to complete surveys that we use for research purposes, although you do not have to respond to any such requests;

2.1.7            if you contact us, we may keep a record of that correspondence; and

2.1.8            we will keep details of transactions you carry out through the Website, fulfilment of your orders, details of your visits to the Website including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.

2.2           If you do not provide information which we reasonably request, then you may not be able to access the full range of features on the Website or the Applications.

  1. HOW WE USE YOUR PERSONAL DATA

3.1           We may use your Personal Data to report alleged or perceived discriminatory activity or behaviour to any football club in the United Kingdom (including any grass roots football club and any professional football club) and/or to the following professional sporting bodies:

3.2           We reserve the right to pass your Personal Data to the police in the event that a criminal investigation is launched or pursued in relation to any alleged or perceived discriminatory activity or behaviour which you have reported.  Your Personal Data may be used as evidence in a criminal investigation or prosecution.

3.3           We may use your Personal Data in the following ways:

3.3.1            in order to:

(a)          process any information, report or Personal Data submitted by you;

(b)          verify your identity;

(c)          make general improvements to the Website and/or the  Applications;

(d)          obtain your views or comments on the services we provide;

(e)          send you information which we think you might find useful;

(f)            ensure that content from the Website is presented in the most effective manner for you and for your computer;

(g)          provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes; and/or

(h)          carry out our obligations arising from any contracts or agreements entered into between you and us;

3.3.2            in order to process any orders made for Kick It Out merchandise or any other products which are offered for sale via the online shop on the Website;

3.3.3            in the event that you report alleged or perceived discriminatory activities or behaviour either via the Applications or on the Website, we may contact any football clubs or professional sporting bodies listed above in order to notify them of an incident involving alleged or perceived discriminatory activity or behaviour, so that applicable club safety officers are fully informed of such incident in a timely fashion and may take appropriate actions to prevent any further discriminatory activity or behaviour;

3.3.4            to ask for your feedback or to ask you to participate in surveys;

3.3.5            to contact you by electronic means (e-mail or text message (SMS or MMS)) with news or updates regarding the status of the Kick It Out campaign; and

3.3.6            to contact you (or allow selected third parties to contact you) by post or telephone with information about goods and services which may be of interest to you, but only if you have indicated that you wish to receive such communications.  Selected third parties may also do so by email, but only if you have consented to receive such communications.

3.4           We will not provide our advertisers with aggregate information about our users. We do not disclose information about identifiable individuals to advertisers.

3.5           If you do not want us to contact you by electronic means you may opt out at any time.  You can exercise this right at any time by either unsubscribing via the link on any email we send you or by emailing info@kickitout.org.

  1. WHERE WE STORE YOUR PERSONAL DATA

4.1           Any Personal Data submitted via the Website will be stored on our systems and/or servers.

4.2           The Applications are hosted and stored on the systems and/or servers of Salesforce.com.

4.3           Any Personal Data submitted via the Applications will be stored on the systems and/or servers of Salesforce.com.

4.4           Any Personal Data submitted via the Applications will also be stored on our servers and/or systems.

4.5           Your Personal Data will be stored on our servers and systems (or the servers and systems of Salesforce.com (as applicable)) for a year or more (at our sole discretion) and will then be archived.

4.6           Your Personal Data may also be stored on the servers and systems of any professional sporting body listed in this Privacy Policy or on the servers and systems of the police or criminal courts (if applicable).

4.7           PayPal processes all orders for Kick It Out merchandise or other products made via the Website. If you make any order for Kick It Out merchandise or other products which are offered for sale via the Website, your Personal Data may also be stored on the servers and systems of PayPal. PayPal is a wholly owned subsidiary of eBay.

4.8           As part of the services offered to you through the Website and Applications, the Personal Data that we collect from you may be transferred to, and stored at a location in a country outside the European Economic Area (“EEA“). By way of example, this may occur if any of our services are located in a country outside of the EEA or one of our service providers is located in a country outside of the EEA. It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the processing of your payment details and the provision of support services. By submitting your Personal Data, you agree to this transfer, storing or processing. Countries outside of the EEA may not provide the same level of legal protection for personal data as that found in the EEA (including under the Act). If we do transfer your information outside of the EEA in this way, we will take reasonably necessary steps to ensure that your Personal Data is treated securely and in accordance with this Privacy Policy.

4.9           If you use our services while you are outside of the EEA, your Personal Data may be transferred outside of the EEA in order to provide you with those services.

4.10        The Website and the Applications use security measures which protect any personal information that is stored on our servers and systems from unauthorised access or use. However, as no data transmissions over the internet can be guaranteed to be 100% secure, we cannot take responsibility for any unauthorised access or loss of personal information that is beyond our reasonable control.

  1. DISCLOSURE or SHARING OF YOUR PERSONAL DATA

5.1           We may disclose your Personal Data to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the Companies Act 2006, or any professional sporting bodies mentioned in this Privacy Policy.

5.2           We may disclose your Personal Data to our business partners or other third parties as follows:

5.2.1            when disclosing aggregate statistics about visitors to the Website or users of the Applications, in order to describe our services to prospective partners or sponsors and other reputable third parties for lawful purposes, but these statistics will contain no personally identifiable information;

5.2.2            in the event that we sell some or all of our business and/or assets to any third party or as part of any business restructuring or reorganisation (in such circumstances we will take steps to ensure that your privacy continues to be protected) or buy any business or assets, in which case we may disclose your Personal Data to the prospective seller or buyer of such business or assets;

5.2.3            if the business of Kick It Out or substantially all of its assets is or are acquired by or transferred to a third party, in which case Personal Data held by it about its users will be one of the transferred assets; or

5.2.4            if we reasonably believe that we are under a duty to disclose or share your Personal Data as required by law (for example, if required to do so by a court order or for the purposes of prevention of fraud or other crime) or in order to comply with any legal obligation, or in order to enforce or apply other agreements we may have with you; or to protect the rights, property, or safety of Kick It Out, our users, or others.

This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

  1. IP ADDRESSES AND INFORMATION AUTOMATICALLY COLLECTED FROM YOUR COMPUTER

6.1           Log files / IP addresses: when you visit the Website our web server automatically records your IP address. This IP address is not linked to any of your personal information. We use IP addresses to help us administer the Website and to collect demographic information for aggregation purposes.

6.2           We may also gather other information (from which we cannot identify you) such as the type of your internet browser which we use to provide you with a more effective service.

  1. COOKIES7.1 Like most websites, when you visit the Website we may store some information (commonly known as a “cookie”) on your computer, mobile phone, tablet or other device.   1. LINKS TO THIRD PARTY SITES AND INFORMATION SECURITY

9.1           The Website and/or the Applications may, from time to time, contain links to and from the websites of our partners, advertisers and associates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for the protection of any data supplied to other sites. You should carefully read the privacy policies of these websites before submitting any personal information.

9.2           This Privacy Policy covers your use of the Website, and your use of the Applications through your tablet or mobile device. Prior to sharing your personal information with any professional sporting body set out in this Privacy Policy or to the police, your information is saved onto our secure database(s).

9.3           You should also be aware that communications over the internet, such as e-mails, are not secure unless they have been encrypted.

9.4           You should note that the information that you submit to us for the reporting of any alleged discriminatory activity or behaviour may also be stored on your tablet or mobile device in unencrypted form and you agree that it is your responsibility to password protect access to your tablet or mobile device to ensure that your information stored on your tablet or mobile device remains secure. Your communications may route through a number of countries before being delivered – this is the nature of the internet.

9.5           Kick It Out cannot accept responsibility for any unauthorised access or loss of personal information that is beyond our control, including access or loss caused by you failing to password protect access to tablet or mobile device.

  1. CHANGES TO OUR PRIVACY POLICY

Our Privacy Policy may change from time to time.  In this case, the amended version will be published on the Website and, where appropriate, notified to you by e-mail or via the Applications.

  1. GOVERNING LAW AND JURISDICTION

This Privacy Policy and any dispute or claim arising out of or in connection with it or its subject matter (including non-contractual disputes or claims) shall be governed by and construed according the laws of England and Wales and you irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction.
